Germany’s new Working Hours Act on electronic time recording – here’s what it says
The new draft law presented by the Federal Ministry of Labor and Social Affairs last month stipulates that the beginning, end and duration of the working hours of all employees in Germany must be tracked electronically in the future. This measure is intended to improve working conditions for employees and create additional legal certainty, after the Federal Labor Court ruled back in September 2022 that all employees’ working hours must be recorded. Companies should now prepare for the changeover as quickly as possible, as the new law is expected to come into force before the end of 2023.
So what does a time tracking system need to be capable of according to the proposed law?
According to the draft law of the Federal Ministry of Labor and Social Affairs, employers must not only introduce a system for tracking working hours, but also apply it properly.
The start, end and duration of working time, breaks and overtime must be recorded. The system must be objective, reliable and accessible, and comply with legal rules on data protection.
The draft bill stipulates that working hours must be recorded electronically on the same day, either through an electronic time tracking system or an electronic spreadsheet such as Excel. Pen and paper recording is allowed only in exceptions. The bill does not specify any requirements for tracking breaks and short activities such as checking work-related e-mails after work.
